This website, rad-power.com, is operated by Ramson Automotive Development LLC under the RAD brand. Throughout these Terms, “RAD,” “we,” “us” and “our” refer to Ramson Automotive Development LLC.

By visiting this website, requesting a quotation or purchasing a product or service from RAD, you agree to these Terms of Service and the policies referenced below.

1. Eligibility and Website Use

You may use this website only for lawful purposes. By placing an order, you represent that you are legally capable of entering into a binding agreement and that the information you provide is accurate and complete.

You may not misuse the website, attempt to interfere with its operation, introduce malicious code, collect information through unauthorized automated means or use RAD’s content or systems for fraudulent or unlawful purposes.

2. Product Information, Pricing and Availability

RAD makes reasonable efforts to present accurate product descriptions, specifications, fitment information, photographs, pricing and availability. Product designs, specifications, packaging and included components may change without notice when a manufacturer revises a product.

Prices and availability are subject to change. RAD may correct typographical, pricing, specification or availability errors and may cancel or modify an affected order. If payment has already been collected for a canceled item, RAD will refund the amount paid for that item.

“Starting at,” estimated and preliminary prices for engines, transmissions, powertrain packages and other configured products are not final quotations. Final pricing depends on the selected configuration, required components, availability, freight and the terms of the applicable written proposal.

3. Orders and Payment

Submitting an order constitutes an offer to purchase. An automated order confirmation acknowledges receipt but does not necessarily constitute final acceptance. RAD may accept an order by confirming it, beginning fulfillment or shipping the product.

RAD may decline or cancel an order because of suspected fraud, incorrect pricing, supplier availability, product discontinuation, payment problems or other material fulfillment issues. If RAD cancels an order after collecting payment, the applicable payment will be refunded.

The customer is responsible for providing accurate billing, shipping and contact information and for all applicable taxes, shipping charges, customs charges or other fees disclosed before purchase.

4. Shipping and Delivery

All shipments are governed by RAD’s Shipping Policy.

Processing and transit dates are estimates unless RAD expressly agrees to a guaranteed date in writing. Carrier and supplier delays may occur outside RAD’s direct control.

Engines, transmissions, complete powertrain packages and other oversized products generally require truck freight and are quoted separately.

5. Returns, Cancellations and Refunds

Returns, ordinary order cancellations and refunds are governed by RAD’s Return Policy.

Products may not be returned without prior authorization. Installed, powered, programmed, tuned, modified, incomplete, custom-built and special-order products are subject to the restrictions stated in the Return Policy or applicable sales agreement.

6. Custom Products, Powertrain Packages and Services

Complete powertrain packages, engines, transmissions, custom-built products, special-order products, dyno testing, tuning and other project-based services may be governed by a separate quotation, proposal, invoice, warranty or sales agreement.

That transaction-specific agreement may establish:

  • Product scope and included components
  • Customer selections and responsibilities
  • Deposits and payment milestones
  • Estimated lead times
  • Change-order procedures
  • Cancellation terms
  • Testing and acceptance criteria
  • Warranty coverage
  • Shipping and delivery requirements

If a transaction-specific written agreement conflicts with these general Terms, the transaction-specific agreement controls for that transaction.

Deposits, custom work and special-order purchases may become nonrefundable once engineering, purchasing, supplier fulfillment, machining, assembly or other project work begins, as specified in the applicable agreement.

7. Application, Fitment and Installation

The customer is responsible for confirming that a product is appropriate for the intended vehicle, engine, transmission, operating environment and use unless RAD expressly assumes that responsibility in a written product-specific agreement.

Recommendations made by RAD are based on the information provided by the customer. Incomplete or inaccurate information can affect fitment, compatibility and performance.

Aftermarket products may require additional components, fabrication, wiring, calibration or vehicle modifications. Unless expressly included in a product description or written agreement, vehicle-specific installation, mounts, exhaust, cooling-system installation, intercooler piping and chassis modifications are not included.

Installation, configuration and commissioning must be completed in accordance with the product instructions and any applicable RAD or manufacturer requirements.

8. Performance Representations

Published horsepower, torque, RPM, response, fuel compatibility and other performance figures describe intended or previously tested results under particular configurations and operating conditions.

Actual results can vary based on engine condition, vehicle configuration, drivetrain losses, fuel, calibration, installation, environmental conditions, testing equipment and other factors. Performance figures are not guarantees unless RAD expressly provides a written performance commitment in a transaction-specific agreement.

9. Emissions and Legal Compliance

Not every aftermarket product is legal for every vehicle, road use or jurisdiction. Products identified as intended only for competition, racing or off-highway use must be used consistently with their labeling and applicable law.

The customer is responsible for determining whether a product and its intended use comply with applicable emissions, registration, inspection, noise, safety and vehicle-equipment requirements.

10. Warranties

Third-party products are generally covered by the applicable manufacturer’s written warranty, if any. RAD may assist the customer with a legitimate manufacturer warranty claim but does not expand or replace the manufacturer’s warranty unless RAD expressly agrees otherwise in writing.

RAD-developed and RAD-built products are covered only by the written warranty supplied with the product or stated in the applicable proposal or sales agreement.

Warranty coverage does not ordinarily extend to damage caused by improper installation, incorrect wiring or plumbing, inadequate supporting systems, misuse, contamination, overheating, detonation, unauthorized modification, incorrect calibration or use outside the product’s stated specifications.

Nothing in these Terms limits any right or remedy that cannot lawfully be limited.

11. Limitation of Liability

To the fullest extent permitted by law, RAD will not be liable for indirect, incidental, special, exemplary or consequential damages arising from the website or a product or service, including lost profits, lost revenue, lost vehicle use or loss of business opportunity.

Except where a written RAD warranty or sales agreement expressly provides otherwise, RAD is not responsible for labor, diagnosis, removal, reinstallation, towing, storage, vehicle rental or other incidental costs associated with a product return, warranty claim or compatibility issue.

To the fullest extent permitted by law, RAD’s total liability arising from a product or service will not exceed the amount paid to RAD for the specific product or service giving rise to the claim.

These limitations do not apply to liability that cannot legally be excluded or limited.

12. Third-Party Products and Links

RAD sells and references products made by third-party manufacturers. Manufacturer names, product names and trademarks belong to their respective owners. Their appearance on this website does not imply ownership by RAD or a relationship beyond the one expressly stated.

The website may contain links to third-party websites. RAD does not control and is not responsible for the content, availability, security or policies of those websites.

13. Intellectual Property

The RAD name, RAD logo, original photographs, graphics, product descriptions, technical content, page designs and other original website materials are owned by or licensed to Ramson Automotive Development LLC.

These materials may not be copied, reproduced, republished, distributed or used commercially without written permission from RAD, except for ordinary personal use or lawful sharing of links to RAD’s public pages.

14. Privacy

Personal information submitted through the website is handled according to RAD’s Privacy Policy.

15. Governing Law and Venue

These Terms and transactions with RAD are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

To the extent permitted by law, any legal proceeding arising from these Terms or a transaction with RAD must be brought in a court of competent jurisdiction located in Brevard County, Florida.

16. Severability and Waiver

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. A failure by RAD to enforce a provision in one instance does not waive the right to enforce it later.

17. Changes to These Terms

RAD may update these Terms periodically. The current version will be posted on this page with its effective date. Changes apply prospectively from the date posted unless applicable law requires otherwise.
